Data and Medical Records Policy

Data and Medical Records Policy
Platform: Easy Second Opinion
Jurisdiction: Republic of India
Applicability: All Domestic and Cross-Border (International) Users
Effective Date: 19/09/2026

1. Scope and Underlying Clinical Reality
This Data and Medical Records Policy ("Records Policy") governs the technical, operational, and medico-legal conditions under which users upload, transmit, and maintain medical information on Easy Second Opinion ("Platform").
The User ("Patient") expressly acknowledges that a remote second opinion is an intellectual interpretation dependent entirely upon historical, diagnostic, and descriptive clinical data. The Platform and its empanelled Registered Medical Practitioners (RMPs) conduct no physical tactile examination, tissue palpation, or direct laboratory sampling. Consequently, the clinical veracity of the final Second Opinion Report is wholly contingent upon the integrity, precision, legibility, and completeness of the records furnished by the User.

2. Patient Obligations and Standards of Submission
To enable a safe, meaningful, and accurate clinical review, the User must strictly comply with the following submission protocols:
Completeness of Records: The User must furnish all relevant medical data, including comprehensive outpatient notes, previous surgical discharge summaries, operative logs, histopathology/biopsy reports, immunohistochemistry profiles, clinical laboratory readouts, and radiological surveys.
Negative Information Disclosure: The User is legally obligated to disclose pre-existing comorbidities (e.g., diabetes, cardiovascular pathologies, renal impairment), known allergies, current pharmacological regimens (including dosages and over-the-counter supplements), and prior adverse reactions.
Digital Imaging File Standards: Radiologic examinations (CT, MRI, PET, Mammography, X-rays) must be uploaded in their native, uncompressed digital formats—preferably as standard DICOM (Digital Imaging and Communications in Medicine) files with associated metadata. Uploading compressed JPEGs, low-resolution photographs of film held against windows or backlights, or cropped screenshots is strictly prohibited as it compromises diagnostic precision.
Zero Omission Warranty: The User warrants that they have not selectively curated, expunged, or withheld medical records that could alter an RMP’s clinical impression.

3. The "Garbage In, Garbage Out" Doctrine & Medico-Legal Indemnification
Absolute Exclusion of Liability for Data Defects: The User explicitly recognizes the clinical doctrine of Garbage In, Garbage Out. Neither Easy Second Opinion nor any consulting RMP shall bear any legal, financial, or clinical liability for misdiagnosis, delayed diagnosis, diagnostic omission, or therapeutic failure if such outcome is traceable to:
Illegible, corrupted, blurry, or low-resolution imaging files.
Incomplete, fragmented, or missing medical documentation.
Omission of historical or concurrent clinical diagnoses.
Forged, altered, fabricated, or third-party-attributed laboratory reports.
Full User Indemnity: The User agrees to defend, indemnify, and hold harmless Easy Second Opinion, its corporate parent, officers, directors, and empanelled RMPs from any third-party claims, legal actions, damages, or malpractice allegations resulting directly or indirectly from defective, altered, or inadequate records uploaded under the User’s account.

4. Language, Translation, and Algorithmic Disclaimers
Mandatory Language of Review: All medical documentation, physician progress notes, and investigative reports must be submitted in the English language.
Third-Party Certified Translation: If original records are rendered in a language other than English (e.g., Arabic, Russian, French, Spanish, Japanese), the User must supply an accompanying certified translation executed by an accredited professional medical translation service.
Disclaimer on Algorithmic Machine Translations: The Platform strictly prohibits and rejects records translated via public automated translation engines (e.g., Google Translate, deep-learning consumer apps). Nuances in clinical terminology, diagnostic qualifiers (e.g., "poorly differentiated" vs. "well-differentiated"), and pharmacological units are frequently mistranslated by automated software. The Platform and its consultants disclaim all liability for clinical errors arising from inaccurate, amateur, or machine-generated translations provided by the User.

5. Physical Records, Diagnostic Films, and

Courier Disclaimer
Digital-Only Platform Architecture: Easy Second Opinion is designed and operated as an entirely digital, paperless platform.
Mailing Disclaimer: Users are explicitly advised against dispatching physical hardcopy films, glass pathology slides, biopsy tissue blocks, or hardware drives (CD-ROMs, USB storage) to the Company’s registered offices.
Exclusion of Transit and Storage Liability: If a User dispatches physical items without express written authorization from the Platform:
The Company assumes zero responsibility for loss, theft, structural damage, customs impoundment, or environmental degradation of such materials in transit or on platform premises.
The Platform is under no obligation to re-package, return, or courier physical records back to the User's domestic or international origin.
The Platform reserves the right to securely destroy unsolicited physical materials following a 30-day notice period.

6. Immutability of Final Medical Reports
Statutory Medical Record Status: Once an empanelled RMP finalizes, digitally signs, and uploads a Second Opinion Report to the User dashboard, that report immediately becomes an official, immutable clinical record under Indian law.
Prohibition of Retrospective Alterations: Under no circumstances will an RMP or the Platform alter, edit, or manipulate the clinical conclusions, diagnoses, or text of an issued report at the request of a User, patient family member, or third party (e.g., to satisfy commercial insurance claim requirements or alter disability ratings).
Addenda Protocol: If significant new medical documentation is supplied after report finalization, the original report will remain intact, and a distinct, formally dated "Clinical Addendum" may be appended at the sole clinical discretion of the RMP, subject to supplementary review fees.

7. Cross-Border Prescription & Treatment Plan Limitations
Jurisdictional Boundary of Licensure: Consulting RMPs are licensed to practice medicine within the sovereign territory of India under the authority of the National Medical Commission (NMC).
Advisory Status: Any pharmacological suggestions, therapeutic protocols, surgical indications, or dosage guidelines articulated
in the Second Opinion Report represent advisory academic recommendations based on international best clinical practices.
Non-Prescription Instrument: The Second Opinion Report does not constitute a legally dispensable prescription in jurisdictions outside the Republic of India. International patients cannot use the report to demand pharmaceutical dispensing in foreign territories (e.g., US, UK, EU, UAE). All therapeutic recommendations must be submitted to the Patient's locally licensed, in-person primary healthcare provider for validation, local prescription issuance, and clinical administration.
