These Terms of Use (“Terms”), together with the Privacy Policy and the Cancellation and Refunds Policy (collectively the “Agreement”), govern the access to and use of the platform offered through https://www.easysecondopinions.com (“Platform”).
The Platform facilitates remote second opinion consultation services (“Services”) provided by qualified healthcare practitioners (“HCPs”).
1. The Agreement
This Agreement is a legally binding contract between [Your Company Name Private Limited] (collectively “Company“, “we“, or “us“) and you, the user of the Platform (“Patient”, “you”, or “your”).
Authority: If you are accessing the Platform on behalf of a minor or a patient unable to provide consent, you represent that you are the legal guardian or have the explicit authority to bind such patient to this Agreement.
Legal Compliance: This Agreement is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
2. Acceptance of Terms
BY CLICKING “I AGREE,” OPENING AN ACCOUNT, OR UPLOADING MEDICAL RECORDS, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT. If you do not agree to these terms, you must immediately cease using the Platform. Under the Indian Contract Act, 1872, your electronic acceptance constitutes a valid and legal signature.
3. Eligibility
Age: You must be at least 18 years of age to create an account.
Minors: Users between 13 and 18 years may use the platform only under the supervision of a parent or legal guardian.
Prohibition: Use of the Platform by anyone under 13 years is strictly prohibited.
4. Nature of Service (Medical Disclaimer)
EASYSECONDOPINIONS.COM IS AN INTERMEDIARY PLATFORM AND NOT A MEDICAL PROVIDER.
No Emergency Services: The Platform is not for emergency medical situations. If you are experiencing a medical emergency, call your local emergency number (e.g., 102 or 112 in India) or visit the nearest hospital.
Informational Purposes: The second opinions provided are for informational purposes to assist in decision-making and do not replace a physical, in-person examination by a doctor.
No Doctor-Patient Relationship with the Platform: Your relationship with the Company is purely for platform usage; the medical relationship exists solely between you and the HCP.
5. Patient Obligations
To provide an accurate second opinion, you agree to:
Provide true, accurate, and complete medical history and records.
Ensure that all uploaded files (DICOM images, blood reports, etc.) are of high quality.
Comply with all applicable Indian laws while using the Platform.
6. Privacy and Data Protection
Your data is governed by our Privacy Policy and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. We implement industry-standard encryption to protect your sensitive personal medical records.
7. Limitation of Liability
To the maximum extent permitted under Indian law, the Company shall not be liable for:
Any diagnostic errors or treatment recommendations made by the HCPs.
Technical glitches, server downtime, or loss of data beyond our reasonable control.
Any indirect, incidental, or consequential damages.
8. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the Laws of India. Any disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts located in [Your City, e.g., New Delhi/Mumbai], India.
